Terms of Use

Welcome to StrideUp. These Terms of Use (the "Terms") govern your access to and use of the StrideUp mobile application, its content, features, software, and related services (collectively, the "Services").

Please read these Terms carefully. By downloading, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and Acceptance

You must be at least 13 years old to use the Services. If the law where you live requires you to be older to enter into these Terms, that higher age applies. If you are not legally able to enter into a binding agreement, you may use the Services only with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

You represent that you are not prohibited from using the Services under applicable law. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes the organization.

2. The Services

StrideUp may provide step and activity tracking, progress insights, goals, challenges, rewards, advertising-supported features, and other wellness-related functionality. Available features may differ by device, operating system, app version, region, and eligibility.

We may add, modify, suspend, or discontinue any feature or part of the Services. Where reasonably practicable, we will provide notice of a material change. We are not liable for a modification, suspension, or discontinuation except where applicable law provides otherwise.

Health and activity disclaimer

StrideUp is intended for general informational, fitness, and wellness purposes only. It is not a medical device and does not provide medical advice, diagnosis, monitoring, or treatment. Activity figures, calorie estimates, distance, and other results may be incomplete or inaccurate because they depend on device sensors, algorithms, settings, placement, connectivity, and user behavior.

Do not rely on the Services for medical decisions or emergencies. Always seek advice from a qualified healthcare professional about a medical condition and before beginning or changing an exercise program. Stop exercising and seek appropriate assistance if you experience pain, dizziness, shortness of breath, or other concerning symptoms.

3. Accounts and Security

If an account feature is available, you agree to provide accurate information and keep it current. You are responsible for safeguarding your credentials and for activity under your account. Notify us promptly at fifa.app@gmail.com if you suspect unauthorized access.

You may not transfer, sell, rent, or share an account or use another person's account without permission. We may reject or require changes to a username that impersonates another person, infringes rights, or is misleading or offensive.

4. Limited License

Subject to these Terms, StrideUp grants you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the Services on a compatible device that you own or control, solely for lawful, non-commercial use.

This license does not transfer ownership. Except as allowed by law or with our written permission, you may not copy, modify, distribute, sell, lease, sublicense, publicly display, reverse engineer, decompile, disassemble, extract source code from, scrape, or create derivative works of the Services or their content.

5. Acceptable Use

You agree not to:

  • violate any applicable law, regulation, or the rights of another person;
  • use the Services for fraud, deception, harassment, abuse, exploitation, or other harmful activity;
  • manipulate steps, activity, referrals, ad interactions, rewards, or eligibility through automation, emulation, tampering, false information, multiple accounts, or any other artificial means;
  • upload or transmit malware, harmful code, spam, unlawful content, or content that infringes intellectual property, privacy, publicity, or other rights;
  • interfere with the Services, bypass technical restrictions, defeat security measures, probe for vulnerabilities, or gain unauthorized access to systems, accounts, or data;
  • use bots, scripts, crawlers, scraping tools, or similar automated methods to access or extract data from the Services without written permission;
  • impersonate another person or misrepresent your identity, affiliation, location, or eligibility;
  • collect another user's information without authorization;
  • use the Services or their content to build or train a competing product or service unless applicable law expressly allows it; or
  • encourage, assist, or attempt any prohibited activity.

We may investigate suspected violations, remove content, reverse improperly obtained benefits, restrict access, suspend or terminate accounts, and cooperate with lawful authorities. Our decision not to enforce a provision in one instance is not a waiver of our right to enforce it later.

6. Points, Rewards, and Promotions

If StrideUp offers points, coins, credits, badges, rewards, sweepstakes, challenges, or promotional benefits (collectively, "Rewards"), the following rules apply unless specific promotion rules state otherwise:

  • Rewards are promotional, have no cash value, are not legal tender or property, and do not create a bank, stored-value, investment, or deposit account.
  • Rewards are personal, revocable, non-transferable, and may not be sold, traded, combined, or exchanged except through a method expressly offered by StrideUp.
  • Eligibility, calculation methods, availability, redemption thresholds, limits, expiration dates, inventory, and participating regions may change.
  • Displayed activity does not guarantee Reward eligibility. We may verify activity and withhold, adjust, cancel, or reverse Rewards associated with errors, abuse, fraud, prohibited conduct, or a violation of these Terms.
  • Third-party reward suppliers may impose additional terms, identity or eligibility checks, delivery restrictions, and expiration dates. Their fulfillment obligations are their own.

We will not retroactively remove an earned Reward solely to avoid fulfillment, but a Reward may become unavailable because of expiration, supplier inventory, legal restrictions, service termination, fraud review, or another reason disclosed in the applicable rules. Where required by law, we will provide an appropriate substitute or remedy.

7. User Content and Feedback

If the Services allow you to submit text, images, comments, or other material ("User Content"), you retain ownership of your User Content. You represent that you have all rights needed to submit it and that it complies with these Terms.

You grant StrideUp a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt, display, and transmit User Content only as reasonably necessary to operate, improve, secure, and provide the Services and to make content available as you direct. This license ends when the User Content is deleted from active systems, except to the extent retention is required for backups, legal compliance, dispute resolution, or content you shared with others who have not deleted it.

Suggestions and product feedback are voluntary and non-confidential. You grant us the right to use them without restriction or compensation, but we are not required to use them.

8. Intellectual Property

The Services, including their software, design, text, graphics, logos, trademarks, and other content other than User Content, are owned by or licensed to StrideUp and are protected by intellectual property laws. All rights not expressly granted in these Terms are reserved.

If you believe content available through the Services infringes your copyright or other intellectual property rights, send a notice to fifa.app@gmail.com with:

  • your name and contact information;
  • identification of the protected work or right;
  • identification and location of the allegedly infringing material;
  • a statement explaining why you believe the use is unauthorized;
  • a statement that the information in your notice is accurate and that you are the owner or authorized to act for the owner; and
  • your physical or electronic signature.

We may request additional information and will respond as required by applicable law.

9. Third-Party Services and Advertising

The Services may contain advertisements, links, offers, integrations, or content provided by third parties. We do not control and are not responsible for third-party services, content, availability, security, privacy practices, or interactions. A link or integration does not imply endorsement. Your use of a third-party service is between you and that third party and may be subject to additional terms.

10. Privacy

Our Privacy Policy explains how we collect, use, share, and protect information in connection with the Services. By using the Services, you acknowledge those practices.

11. Suspension and Termination

You may stop using the Services at any time. If account deletion is available, you may use the in-app process or contact us.

We may suspend or terminate access, remove content, or restrict features if we reasonably believe you violated these Terms, created risk or legal exposure, engaged in fraud or abuse, or if suspension is necessary to protect the Services or others. Where appropriate and legally required, we will provide notice and an opportunity to appeal.

Upon termination, your license ends immediately. Provisions that by their nature should survive will remain in effect, including those concerning ownership, disclaimers, limitations of liability, disputes, and miscellaneous terms.

12. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available." StrideUp disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and security.

We do not warrant that the Services will be uninterrupted, error-free, completely secure, or compatible with every device; that activity data or other results will be complete or accurate; that defects will always be corrected; or that any Reward, offer, or third-party service will remain available or meet your expectations.

Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

13. Limitation of Liability

To the fullest extent permitted by law, StrideUp and its affiliates, licensors, service providers, and their respective personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, goodwill, opportunity, use, or data, arising out of or related to the Services or these Terms, even if advised that such damages are possible.

To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed US$100.

These limitations do not apply to liability that cannot legally be limited or excluded, including where applicable liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, or death or personal injury caused by negligence. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless StrideUp and its affiliates, licensors, service providers, and personnel from claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful use of the Services, your User Content, or your material breach of these Terms or another person's rights. This section does not require you to indemnify a party for its own unlawful conduct and does not limit any non-waivable consumer rights.

15. Governing Law and Disputes

Before filing a formal claim, you and StrideUp agree to try in good faith to resolve the dispute informally for at least 30 days. Send a notice describing the dispute and requested resolution to fifa.app@gmail.com. We will use the contact information available to us to respond.

These Terms are governed by the laws applicable in the jurisdiction where the operator of StrideUp is established, without regard to conflict-of-law rules, except that mandatory consumer protections in your place of residence remain available to you. Any dispute not resolved informally may be brought before a court of competent jurisdiction. Nothing in these Terms prevents either party from seeking urgent injunctive relief or using an applicable small-claims or consumer-protection process.

16. Changes to These Terms

We may update these Terms to reflect changes to the Services, our practices, or applicable law. We will post the revised Terms and update the "Last updated" date. If a change materially affects your rights, we will provide additional notice where required. Changes apply prospectively from their effective date. If you do not agree to updated Terms, you must stop using the Services.

17. Miscellaneous

These Terms and the Privacy Policy form the entire agreement between you and StrideUp regarding the Services, except for any additional terms presented for a particular feature or promotion. If there is a conflict, the specific additional terms control for that feature.

If a provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them in connection with a reorganization, merger, acquisition, sale of assets, or by operation of law, provided your rights are not materially reduced.
